It may not be strictly correct to describe this as a bio–pic. Wikipedia describes it as "revisionist", and it describes the book (of the same title, by Ron Hanson), on which it's based, as a historical novel.
The book is based on a well–known contemporary folk song (i.e. contemporary to the subject), and "weaves a third–person narrative of actual events with fictionalized imaginings of the lives of Jesse, his brother Frank, and their followers".
